Delhi GSTAT State Bench Opens in Chanakyapuri Temporary Location
The Delhi Goods and Services Tax Appellate Tribunal (GSTAT) State Bench has commenced operations from a temporary location in Chanakyapuri, Delhi.
The commencement of the Delhi GSTAT State Bench from its temporary location in Chanakyapuri addresses a critical need for efficient GST dispute resolution. The GSTAT is the forum for taxpayers to appeal orders passed by GST authorities. Its absence has long delayed resolution. The Delhi GSTAT will hear appeals against orders related to CGST, SGST, and IGST. Taxpayers aggrieved by orders concerning demand, ITC denial, or registration cancellation can now file appeals. For instance, a Delhi-based business denied ITC of ₹5 lakhs can appeal to the GSTAT after exhausting other options. This operational bench offers a swifter and more specialized avenue for resolving GST disputes than traditional courts. This is particularly relevant for businesses facing demands under Section 74 of the CGST Act. The bench's presence in Delhi ensures accessibility for taxpayers within the state, reducing logistical burdens and promoting compliance.
The GSTAT's authority stems from the CGST Act, 2017, which outlines the appellate process and powers of the tribunal. Section 112 specifies the procedure for appeals to the Appellate Tribunal. Failure to comply with orders passed by the GSTAT can attract penalties under Section 122 of the CGST Act.
The operationalization of the Delhi GSTAT bench is a welcome move, but its effectiveness will depend on the speed of disposal of cases and the quality of its rulings. Taxpayers should carefully document their cases and seek expert advice to navigate the appellate process effectively.
The Delhi GSTAT State Bench is now operating from Chanakyapuri, providing a forum for GST appeals.
