Legal Source & Citation Policy
TaxIntelHub enforces a strict hierarchy of legal authorities. Primary legal sources (Statutes, Subordinate Rules, Gazette Notifications, Court Judgments) always supersede editorial analysis and secondary commentary.
1. The Source Hierarchy
Legal information on TaxIntelHub is structured according to the established doctrine of legal sources in India:
Tier 1: Primary Binding Legal Authority
- Statutory Legislation: Acts passed by the Parliament of India (CGST Act 2017, IGST Act 2017, UTGST Act 2017, Customs Act 1962, Income Tax Act 1961) and State Legislatures (SGST Acts).
- Subordinate Legislation: Statutory rules notified under delegated legislative powers (e.g. CGST Rules 2017, Customs Valuation Rules).
- Statutory Notifications: Official notifications issued by the Central Government / CBIC and published in the Gazette of India under statutory authority (e.g. rate changes, exemption notifications, effective dates).
- Judicial Precedents: Judgments and orders delivered by the Supreme Court of India (Article 141 binding on all courts) and jurisdictional High Courts (binding within their territorial jurisdiction).
- Tribunal Decisions: Orders of the Customs, Excise and Service Tax Appellate Tribunal (CESTAT) and Income Tax Appellate Tribunal (ITAT).
Tier 2: Administrative Guidance & Clarifications
- CBIC Circulars & Instructions: Administrative circulars and guidelines issued under statutory powers (e.g. Section 168 of the CGST Act). Binding on tax officers, informative for taxpayers, but subject to judicial interpretation.
- Orders & Trade Notices: Administrative directions issued by Commissioners and Directorates.
Tier 3: Secondary Analytical & Reference Material
- TaxIntelHub Editorial Analysis: Structured case law summaries, statutory explainers, ratio analyses, and topic hubs prepared by TaxIntelHub.
- External News Directory: Curated external reports linking to original publishers with attribution.
2. Clear Demarcation of Content
TaxIntelHub visually and structurally distinguishes between:
- "What the Source Says": Verbatim or exact statutory text, notification text, and judicial holdings.
- "TaxIntelHub Analysis": Explanatory commentary, practical implications, and cross-references. Commentary is never presented as the statutory text or court's own language.
