This CBIC Notification No. 06/2026-Central Tax (Rate), dated 27th October, 2026, amends Notification No. 11/2017-Central Tax (Rate) to implement recommendations from the 57th GST Council meeting.
Key Statutory Clarifications & Analysis
1. Applicability & Compliance Framework
Effective from 1st November, 2026, the primary focus is on rationalizing Input Tax Credit (ITC) for specific services, particularly those provided through an intermediary or involving electrically operated vehicles.
Point 2
It introduces a restricted ITC mechanism for certain services like hotel accommodation, restaurant services, outdoor catering, and transportation/renting of electrically operated vehicles, where the ITC on 'same line of business' input services is capped at the output tax rate (typically 2.5% CGST).
Point 3
It clarifies the definition of 'goods transport agency' and introduces a definition for 'electrically operated vehicle'.
4. Applicability & Compliance Framework
These changes aim to prevent ITC accumulation and streamline tax compliance for businesses operating in these sectors, especially those utilizing a cascading service model.
Procedural Changes & Compliance Impact
- ITC restriction for 'same line of business' input services in hotel accommodation, restaurant, and outdoor catering services.: Taxpayers providing these services will only be able to claim ITC on input services from the 'same line of business' up to the output CGST rate of 2.5%, even if the input service provider charged a higher rate. This will increase the effective cost for intermediaries in these sectors.
- Introduction of new service categories for electrically operated vehicles (EOVs) with restricted ITC.: Transportation of passengers and renting of EOVs (where battery charging cost is included) are now subject to a 2.5% CGST rate, with ITC on 'same line of business' input services (e.g., hiring another EOV) capped at 2.5%. This impacts businesses operating electric mobility services, limiting their ITC claims.
- Amendment to 'Delivery services' under serial number 12, item (iii).: Delivery services supplied through an e-commerce operator by unregistered persons, and delivery services in relation to goods supplied through an e-commerce operator, are now explicitly subject to 2.5% CGST with a condition of no ITC on goods and services used in supplying the delivery service. This clarifies the tax treatment for last-mile delivery services, especially those facilitated by e-commerce platforms.
- Clarification of 'goods transport agency' (GTA) definition and introduction of 'electrically operated vehicle' definition.: The GTA definition now explicitly requires the issuance of a consignment note. The new definition of 'electrically operated vehicle' provides clarity for the application of the new tax rates and ITC conditions, ensuring consistent interpretation across the industry.
