Implementing certain recommendations of the GST Council in its 57th meeting held on 08.10.26 at New Delhi, prior to the legislative amendments
This CBIC Instruction No. 02/2026-GST, dated October 30, 2026, outlines the interim implementation of key recommendations from the 57th GST Council meeting (October 8, 2026), ahead of formal legislative amendments.
-
Withdrawal of arrest powers under GST by omission of Section 69 of the CGST Act, 2017.CGST field formations are directed to cease all arrests under GST immediately. This significantly reduces the potential for coercive action against taxpayers, fostering a less intimidating compliance environment.
-
Rationalization of e-way bill related interception and verification procedures.Conveyances can now only be intercepted based on specific, authorized intelligence. Inspections are generally restricted to the intercepting officer's jurisdiction, with provisions for information sharing for out-of-jurisdiction cases. This aims to reduce arbitrary checks and harassment, streamlining goods movement, except where no e-way bill or origin/destination documents are produced.
-
Prescription of a minimum threshold of Rs. 10,000/- (CGST + SGST + IGST + Compensation Cess) for issuance of show cause notices under Sections 73, 74, and 74A of the CGST Act, 2017.Show cause notices will no longer be issued for amounts below Rs. 10,000. This will significantly reduce low-value litigation, compliance costs, and administrative burden for both taxpayers and tax authorities, allowing focus on more substantial cases.
