Procedural Changes & Compliance Impact
- Insertion of Serial No. 10M: Exempts import of services by an establishment of a foreign shipping company in India from a related person or other establishments outside India, when made without consideration.: Provides significant relief to foreign shipping companies operating in India by exempting a specific category of related-party service imports from IGST, reducing their compliance burden and potential tax liabilities.
- Amendment to Serial No. 16: Exempts air travel in helicopters on a seat-share basis embarking from or terminating in airports/helipads in specific North-Eastern states (Arunachal Pradesh, Assam, Manipur, Meghalaya, Mizoram, Nagaland, Sikkim, Tripura) or Bagdogra (West Bengal).: Promotes regional connectivity and tourism in the North-Eastern states by making helicopter travel more affordable, benefiting both service providers and passengers in these regions.
- Amendment to Serial No. 22A and definition of 'goods transport agency': Clarifies that the exemption for GTA services does not apply when goods are supplied through an electronic commerce operator (ECO). The definition of 'goods transport agency' is also refined to explicitly include issuing a consignment note.: Increases the tax base for GTA services facilitated by ECOs, potentially leading to higher costs for businesses using such platforms. The clarified definition provides certainty for GTAs regarding their classification and tax obligations.
- Substitution of Serial No. 25B: Exempts services by way of storage or warehousing of cereals, pulses, fruits, vegetables, and seeds meant for sowing. A new definition for 'seed' is also inserted.: Broadens the scope of agricultural warehousing services eligible for GST exemption, supporting the agricultural sector by reducing costs associated with storage of a wider range of essential agricultural produce and planting materials.
- Insertion of Serial No. 44A: Exempts services by way of grant of exclusive right of way or access, license, and authority to demand, collect, and appropriate toll fee by government entities.: Clarifies and formalizes the exemption for government-related infrastructure services, ensuring that the grant of rights for toll collection and access by government bodies remains outside the GST ambit, thus avoiding potential cascading effects on infrastructure projects.
